Terms and Conditions

These Terms and Conditions govern access to and use of MiEmpleadoIA, a software service operated by Performance Labs SL, VAT ID ESB56217169, Paseo de la Castellana 194, Planta baja, Puerta B, 28046 Madrid, Spain.

1. The Service
MiEmpleadoIA is a supervised AI-assisted workspace for accounting operations. It helps accounting firms and similar professional teams collect documents, organize review queues, extract pre-accounting information, prepare exports, and manage supervised workflows.
MiEmpleadoIA is not an accounting firm, tax advisor, legal advisor, filing service, or official bookkeeping system. The service does not submit tax returns, file public records, make official decisions, or replace professional review.
2. Who May Use MiEmpleadoIA
You may use MiEmpleadoIA if you are legally able to enter into a contract and you use the service for lawful professional or business purposes. If you use MiEmpleadoIA on behalf of an organization, you confirm that you have authority to bind that organization and manage its workspace.
You are responsible for keeping account credentials secure, inviting only authorized users, assigning appropriate roles, and promptly removing access when a user should no longer access the workspace.
3. Customer Responsibilities
You are responsible for:
- The accuracy, legality, and quality of data and documents uploaded to the service.
- Having the necessary permissions and legal basis to process documents, client data, mailbox data, and other information through MiEmpleadoIA.
- Reviewing all AI-generated or software-generated outputs before using them.
- Deciding whether any output is suitable for accounting, tax, legal, client, or internal use.
- Maintaining your own records, backups, professional controls, and compliance processes.
- Using the service only for lawful purposes and in line with these Terms.
You must not use MiEmpleadoIA to upload unlawful content, infringe third-party rights, process data without authorization, bypass security controls, reverse engineer the service, overload the service, or use it to provide harmful, deceptive, or illegal services.
4. Supervised AI And Professional Review
AI-assisted extraction, classification, matching, suggestions, summaries, and other outputs can be incomplete, outdated, or incorrect. MiEmpleadoIA is designed to support supervised workflows, not automatic filing or automatic professional decisions.
You must review and approve outputs before relying on them. Performance Labs SL is not responsible for tax filings, accounting entries, legal conclusions, business decisions, or client communications made from unreviewed or incorrectly reviewed outputs.
5. Subscriptions, Trials, And Billing
MiEmpleadoIA may offer free plans, no-card trials, paid subscriptions, add-ons, and enterprise arrangements. Plan limits, features, prices, taxes, and billing intervals are shown in the app, on the pricing page, or in an agreed order.
Paid subscriptions are billed through Stripe or another payment provider shown at checkout. You authorize us and our payment providers to charge the selected payment method for subscription fees, add-ons, applicable taxes, and renewal charges.
Unless otherwise stated, subscriptions renew automatically until cancelled. You can manage payment methods, invoices, plan changes, and cancellation through the billing page or Stripe Billing Portal when available.
6. Taxes
Prices may be shown excluding VAT or other applicable taxes unless stated otherwise. Taxes may be calculated based on billing details, tax identifiers, location, and applicable law. You are responsible for providing accurate billing and tax information.
7. Cancellation And Refunds
You may cancel a subscription through the billing page or customer portal when available. Unless the checkout, invoice, or mandatory law states otherwise, cancellation takes effect at the end of the current billing period and previously paid fees are not automatically refunded.
We may grant refunds at our discretion or where required by mandatory law.
8. Data Access And Export
Your organization remains responsible for its customer data and documents. We aim to preserve access to existing data even after downgrade or cancellation, subject to plan limits, security requirements, retention periods, and legal obligations. Some new processing, automation, exports, integrations, or advanced workflows may be blocked when a plan expires, is downgraded, or exceeds limits.
You should maintain independent backups of critical records and not rely on MiEmpleadoIA as the only archive for legally required accounting documents.
9. Availability And Changes
We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free operation. The service may be unavailable because of maintenance, security work, provider outages, incidents, or changes.
We may modify, add, or remove features, providers, integrations, limits, or plans. We will try to avoid materially reducing paid functionality during a paid billing period without reasonable notice, unless changes are needed for security, legal, provider, or operational reasons.
10. Support
Support channels and response expectations depend on the plan or agreement. Support does not include legal, tax, accounting, or official filing advice unless expressly agreed in a separate written agreement with a qualified professional.
11. Intellectual Property
Performance Labs SL and its licensors own the software, interface, workflows, branding, documentation, and technology used to provide MiEmpleadoIA. You receive a limited, non-exclusive, non-transferable right to use the service according to these Terms.
You retain rights to the data, documents, and content your organization uploads or creates through the service, subject to the rights needed for us and our processors to provide, secure, improve, and support MiEmpleadoIA.
12. Confidentiality And Security
Each party should protect non-public information received through the service or business relationship with reasonable care. You must notify us promptly if you suspect unauthorized access to your account or workspace.
13. Suspension And Termination
We may suspend or restrict access if we reasonably believe there is non-payment, security risk, unlawful use, breach of these Terms, abuse of the service, or legal necessity. We will use reasonable efforts to limit suspension to the affected account, user, feature, or organization where practical.
You may stop using the service at any time. Termination does not remove payment obligations already incurred or legal obligations that must continue.
14. Liability
To the maximum extent permitted by law, MiEmpleadoIA is provided without warranties that it will be uninterrupted, error-free, or suitable for every specific professional use. Performance Labs SL is not liable for indirect loss, lost profit, loss of business, loss of goodwill, or consequences of unreviewed outputs.
Nothing in these Terms limits liability where limitation is not allowed by mandatory law.
15. Governing Law And Venue
These Terms are governed by Spanish law. Unless mandatory law provides otherwise, disputes will be submitted to the courts of Madrid, Spain.
16. Changes To These Terms
We may update these Terms to reflect legal, product, provider, or operational changes. The updated version will be published on this page. If a change materially affects a paid subscription, we will provide reasonable notice where required.
